Law 874: Advanced Copyright Law Topics -- Fair Use

The seminar will give students with an interest in copyright law an opportunity to explore fair use in greater depth. We will examine the history, public policy, and jurisprudence associated with one of the most flexible and contentious aspects of modern intellectual property law. In particular, we will look carefully at the cases and contexts that shape the fair use legal landscape, as well as how the interests of stakeholders may influence the way courts think about and apply the §107 factors. We will explore the current contours of the rights and doctrines associated with fair use and consider how they might evolve going forward. We will consider not only law and policy, but practical issues related to legal practice in this area. Students will write short weekly essays, and a research paper on a fair use topic of their choice.
