April 11: Fair Use after Andy Warhol Foundation v. Goldsmith
It is too soon to know whether the Supreme Court's decision in Andy Warhol Foundation v. Goldsmith marks a major shift in which uses will be deemed fair or represents only a modest (or temporary) adjustment in courts' fair use analyses. Cases seeking to apply the Supreme Court's instructions in Warhol over the past nine months, though, give us some basis for prediction.
